$200,000 Settlement: Plaintiff argues open and obvious defense in black ice fall

It’s also contended that funeral home parking lot not properly lit at night

On Dec. 28, 2011, plaintiff visited defendant’s funeral home on a cold evening without any snowfall. She was forced to park near the back of the parking lot, which was poorly lit by spotlights affixed to the building and a lone light pole not controlled by the business.

plaintiff took several steps from her car before her feet slipped out from under her and she fell on her right side. It was not until she was on the ground that she said she could feel the patch of black ice. Plaintiff suffered fractures of her right hip, wrist and forearm as a result.
