$2,855,781 Verdict: Death is blamed on a catheterization delay

Repeated bouts of chest pain went unreported by staff, argues the estate

Plaintiff went to defendant's Hospital on a Sunday, complaining of chest pain. She responded to nitroglycerin in the emergency room, and the ER physician ordered an EKG and cardiac stress. She also was assigned an internal medicine physician, who then referred her to defendant, a cardiologist.

Starting at about 11:30 p.m., patient had more bouts of chest pain, was given more nitroglycerin, and had an EKG that showed serious changes but was not reported.

Because certain testing was not performed at the hospital on Sundays, the internist delayed the stress test until Monday, at which time the patient continued to have active chest pain as well as an elevated blood pressure and demanded to see a doctor.

Defendant was summoned by the stress lab, cancelled the stress test, and ordered an EKG that was never performed and a heart catheterization for the next day, Tuesday.

The patient had several bouts of chest pain Monday evening and into Tuesday morning. Neither the nurses, house officer nor intern reported the events to the cardiologist, and she had an arrhythmia at 2:30 a.m. Tuesday, which the hospital staff was unable to reverse. she was pronounced dead at 3:15 a.m.

$245,000 Settlement: Woman falls on ice outside apartment door

Condition is unavoidable on a common front porch; case reaches settlement

On Jan. 28, 2012, plaintiff exited the front door of her apartment at defendant's Apartments. The front door was the only way in and out of the unit. She found that the entire porch area was wet. In addition to wintry weather conditions, the overhang above the porch showed visible signs of damage and regularly leaked.

As she approached the steps leading down from the porch, she slipped on a patch of ice, suffering fractures of her right tibia and fibula which required surgical repair.

Maintenance employees for the complex testified that they failed to salt the common porch area, despite acknowledgment of their responsibility to do so. In addition, Plaintiff argued that the icy condition on the building’s common front porch was unavoidable, and that even without regard to any statutory landlord duties, the open and obvious doctrine did not apply.

On Dec. 28, 2011, plaintiff visited defendant’s funeral home on a cold evening without any snowfall. She was forced to park near the back of the parking lot, which was poorly lit by spotlights affixed to the building and a lone light pole not controlled by the business.

plaintiff took several steps from her car before her feet slipped out from under her and she fell on her right side. It was not until she was on the ground that she said she could feel the patch of black ice. Plaintiff suffered fractures of her right hip, wrist and forearm as a result.

$900,000 Settlement: Electrician blames carpenters for injuries

Sheets of cement board fall onto him, breaking his leg and knee; case settles

In a construction site injury action, plaintiff electrician claimed that defendants, all carpenters, leaned a number of cement board sheets upright against a wall at the jobsite. Many hours later, plaintiff had his leg and knee broken when the sheets fell on him, permanently disabling him.

In her claim, plaintiff alleged that city officials knew the 110-year-old home contained lead-based paint but failed to provide the Environmental Protection Agency-approved pamphlet and a checklist. Under federal law, the city should have provided the disclosure because the home was built before 1978, the argument stated, and that a sales agreement did not include language pertaining to lead-based paint.

The city denied having prior knowledge that lead-based paint existed at the property because city officials had not conducted lead testing (the city is not required to test the property for lead).
