$3,717,948 Verdict: Pastor’s brain injury in low-impact auto accident argued

Argument centers on fact that head needn't hit anything to cause harm
On May 20, 2011, plaintiff, a 54-year-old pastor, was traveling north on Woodward Avenue in Royal Oak. His car was struck by defendant driver, who was operating a vehicle owned by defendant. She veered into plaintiff’s vehicle, striking it near the B-pillar (the second pillar dividing the driver’s compartment from the passenger compartment).
Although the impact was relatively minor, because of his previous history of multiple concussions, it was asserted that plaintiff was extremely vulnerable. He was diagnosed with a traumatic brain injury, a double crush injury to his cervical and thoracic spine, vertical heterophoria (vision problems), acute depression and other injuries.

Type of action: Auto negligence, personal injury
Types of injuries: Mild traumatic brain injury, cervical and thoracic spine injury, vision problems, loss of consortium
Court/Case no.: Oakland County Circuit Court; 11-120796-NI
Tried before: Jury
